REGULAR MEETING

MAY 24, 2016

 

 

PRESENT WERE:  Skip DiCamillo, Tom Machnik, Victoria Fallon and Gary Gregory.

 

MINUTES

 

MINUTES OF REGULAR MEETING DATED, APRIL 26, 2016

 

Tom Machnik made a motion to approve the Regular Meeting Minutes dated April  26, 2016.  Gary Gregory seconded the motion.  The motion passed unanimously.

 

MINUTES OF SITE WALK MEETING DATED MAY 5, 2016

 

The minutes were not completed therefore this item was tabled until the next regularly scheduled meeting.

 

 

OLD BUSINESS

 

16-1OLD LYME CEMETERY ASSOCIATION – 31-2 LIBRARY LANE – PROPOSAL IS TO ENLARGE THE NUMBER OF BURIAL SPACES.

 

The commission walked the site.  Attorney Tom McGarry was present to discuss the application.   The commission and applicant reviewed the comments provided by Keith Rosenfeld.  Attorney McGarry stated that Mr. Rosenfeld indicated in his memo that comments A through I be incorporated into the plan.  McGarry asked for clarification as to which plan these items needed to be incorporated into.  The plan completed by the layout architect or the site plan provided by Angus McDonald & Gary Sharpe & Associates.   Rosenfeld clarified that the notes need to put on the final site plan when the design layout is completed.

Tom Machnik made a motion to approve the that application of the Old Lyme Cemetery Association located at 31-2 Library Lane with the condition that a final design layout plan be submitted and that items A through I outlined in Keith Rosenfeld’s memo dated May 24, 2016 are incorporated as well as made part of the approved signed permit.  Gary Gregory seconded the motion.   The motion passed unanimously. 

 

16-2 – OLD COLONY BEACH ASSOCIATION – SHEFFIELD BROOK – THE PROPOSAL IS FOR FLOODPLAIN RESTORATION AND CULVERT REPLACEMENT.

 

Chris Baker with Fuss and O’Neill discussed the proposed application on behalf of the Old Colony Beach Association.  She also noted that Doug Whalen, Chairman of the association was also present.   Skip DiCamillo noted that the commission visited the site.  Baker gave a brief overview stating that this project is for the Sheffield Brook reconstruction, stream restoration, floodplain restoration and also the installation of twin culverts to convey flow out to the sound.  She noted the project was started to fix the flooding issues.  She stated the flood mitigation that will happen will take approximately 32 homes that were being flooded by inland storms and reduce that to none under the 10 year flood scenario.   She noted it was both do to the upland flood restoration project and also the addition of the twin culverts to replace a single culvert.  

 

Baker once again reviewed the plans with the commission.  She noted they are restoring approximately 1.1 acres through the project both in the floodplain and the channel.  Baker clarified that the entire project is within the FEMA floodplain associated with the Long Island  Sound.  She noted the project will start after Labor Day.  She  noted there are four inland water resource division permits that they are currently in the process of obtaining: Office of Long Island Sound, Army Corp, and the local Harbor Commission approval. 

 

Baker explained that the culvert will be underground for the majority of its length but there is a tidal gate structure that will be accessible in the event of a storm.

 

Tom Machnik made a motion to approve the application with the recommendations outlined in Keith Rosenfeld’s memo dated May 24, 2016.  Victoria Fallon seconded the motion.  The motion passed unanimously.

AMEND THE AGENDA

Skip DiCamillo made a motion to amend the agenda to add the discussion of the Pesticide Application at Rogers Lake.  Tom Machnik seconded the motion.  The motion passed unanimously.

TOWN OF OLD LYME PESTICIDE APPLICATION IN ROGERS LAKE

DiCamillo stated the commission previously had a presentation with regard to this matter.  He noted the question has come up as to whether this commission has jurisdiction over this project.   DiCamillo stated both the state and local regulations are a little nebulous on this matter.   DiCamillo stated he asked Attorney Cassella to opine on this matter.   DiCamillo summarized the letter from Attorney Cassella dated May 24, 2016.  DiCamillo stated the DEEP has approved the project therefore the commission can approve the proposed activities as a permitted as of right but noted that if in the future if pollution is found to have harmful impact on the muscle beds or any other aspect of the lake, the Wetlands commission can reconsider its use of the exemption. 

Gary Gregory made a motion to consider this application as a permitted by right use.   Tom Machnik seconded the motion.  The motion passed unanimously.

Attorney Cassella’s letter is attached as part of the minutes.

17 MCCURDY ROAD – CHRIS CAULFIELD

Skip DiCamillo reported that Keith Rosenfeld sent a letter to the property owner, Chris Caulfield after visiting his site.  He noted in his letter although activities within tidal wetlands are regulated by the CT. DEEP, municipalities are responsible for ensuring that adjacent upland development does not harm these resources.  Rosenfeld outlined several conditions that will need to be followed during the construction process.  Rosenfeld noted that he will continue to monitor the site.

SILL LANE

DiCamillo expressed concern about further activity at the Sill Lane property.  He asked the commission members to have a look prior to the next meeting.  DiCamillo will also follow up with Keith Rosenfeld.   Kim Groves noted that Rosenfeld had sent the property owner a letter.   DiCamillo also stated that at some point the property owner will be submitting an application to the commission for restoration of the site.

ADJOURNMENT

Tom Machnik made a motion to adjourn.  Victoria Fallon seconded the motion.  The motion passed unanimously.
